NORTHERN NEVADA / COUNTY FIELD NOTES

Pershing County.
Verify residential building rights.

AMR parcel history can change whether a residence is allowed.

CONFIRM JURISDICTION FIRST

Development Code applicability is unincorporated Pershing County. Imlay, Imlay–Mill City frontage, Humboldt River Ranch and Grass Valley have distinct area-plan provisions; Lovelock municipal requirements are separate.

What the official sources tell us

  • County planning page says a Development Code update was adopted in December 2024 and links the 2024 compilation (cover says adopted November 20, 2024). Use the new linked code rather than old standalone Division_Five.pdf.

  • In AMR district, section 17.106.85(B) gives a parcel under 160 acres created before June 30, 2007 one residential building right only in conjunction with agricultural, mining and/or recreational use. Paragraph C requires AMR divisions after June 30, 2007 creating parcels under 160 acres to state on the recorded map that they have no residential building rights. Chapter 17.503 sets additional residential permit/site/access requirements.

Ask Planning to verify creation date, district, existing rights and later amendments; do not treat every 40-acre parcel as buildable.

  • General section 17.322.40(A) allows temporary quarters during construction in applicable zones with a concurrent permanent-residence permit; states 18 months or 30 days after occupancy certificate, whichever sooner, plus financial assurance and restricted extension. Grass Valley section 17.208.10 has a distinct administrative-review provision of up to one year.

Do not collapse these provisions into a countywide RV limit.

  • Building department lists permits for construction, remodels, septic systems and manufactured homes and publishes Solar Building Guide and site design information.

How to use this research

Make recorded residential building rights and road/fire/water compliance the first purchase-screening questions, ahead of acreage or price.

This is a buyer-research recommendation, not a county determination. Use the parcel number and exact proposal when requesting an answer.

Questions still specific to your parcel

  • Whether AMR parcel has lawful residential rights
  • Area-plan overlays
  • Approval of proposed solar as dwelling energy source

Also verify title and legal access, accepted water and wastewater, total installed costs, hazard exposure, lender acceptance and insurance. A general county rule does not settle these site-level questions.

Prepare for the agency conversation

Provide the APN, legal description, proposed building type, intended occupancy, water plan, wastewater plan and a simple site sketch. Ask which current code, planning area and approval pathway apply, and request a written response you can keep with your due-diligence file.

Use the 20-point buyer checklist

Source check: November 6, 2026. Official code compilations and handouts can lag amendments. For older documents, current agency confirmation remains necessary. These county notes apply only within the scope described above.
